The Justice Department charged two former senior FBI officials with lying to Congress about the bureau’s Hunter Biden work on Friday, and it did so with a criminal complaint rather than a grand jury indictment, 11 days before Election Day.
Here is what is established:
- Nikki Floris, 46, and Bradley Benavides, 56, are former leaders of the FBI’s Foreign Influence Task Force, the unit that worked on election interference around 2020.
- Each faces one count of making false statements to Congress, over 2023 interviews with House Judiciary Committee investigators.
- Both appeared Friday before Magistrate Judge Zia Faruqui. A preliminary hearing is set for Tuesday.
- Election Day is November 3. We counted 11 days from Friday.
What prosecutors say
Benavides told lawmakers he learned the FBI had the laptop from Wikipedia. The complaint, as the AP reported it, says Biden was “a recurring subject at FITF meetings” and that both had “firsthand knowledge” they concealed. U.S. Attorney Jeanine Pirro said the pair “allegedly lied to Congress about their roles in the FBI’s Hunter Biden investigations.” FBI Director Kash Patel said “no one is above the law.”
What the defense and the judge say
Floris’s attorneys called her “a patriot” with nearly 20 years at the bureau and said she was charged “on the say-so of politicians, not on the facts,” on “the eve of an election.” Faruqui noted both defendants’ “sparkling backgrounds” and said charging longtime public servants by complaint over years-old conduct is unusual.
A Complaint Is Not an Indictment
A complaint is a prosecutor’s sworn account of the case. An indictment means a grand jury of citizens has looked at the evidence and found probable cause. Nobody outside the prosecution has tested this case yet, and the one person who has looked at it from the bench called the method unusual. That remark is the detail to hold onto.
We think the calendar is the story. The testimony dates to 2023. Biden’s pardon came in December 2024, and Attorney General Pam Bondi disbanded the task force in February 2025, according to the AP. Nothing about the alleged lies changed this month. The distance to the election did. A complaint filed on a Friday delivers a headline that a grand jury timeline would not, and this Justice Department has already tried this playbook on people the president named as enemies: the cases against James Comey and Letitia James were thrown out by a judge.
Whether Floris and Benavides lied is a question for a court, and the charges are allegations until a court says otherwise. Whether the department should pick the last two weeks of a campaign to ask is not a hard question. It should not.
Watch Tuesday. A preliminary hearing is the first time prosecutors have to put evidence in front of a judge in open court, and it will show how much of the complaint’s account survives being questioned.
